Application Process

To apply for to be a Mobile Vendor, please completely fill out the Vendor Application. Once our management has reviewed your application, we will send you a link to submit your documents, including a signed copy of this Mobile Food Vendor Agreement.

Payments will not be processed until your application is approved with appropriate documentation. All fees are non-refundable once the application has been processed.

 

Vendor General Terms & Policies

Space:

Common Grounds is providing space for mobile vendors (including food trucks, food trailers, and stationary push-carts) in addition to common space for customer use. Space is limited to 3 mobile vendors each month on a rotating schedule throughout the summer and space allocations are made on a first come, first served basis. We do not provide on-site bathroom or customer parking. Any additional material requirements will be vendor’s responsibility. All signage may not protrude outside of allocated space unless previously approved in writing by Common Grounds management. You may not encroach upon neighboring space.

Permits:

Vendors must have and provide copies of all permits required to vend within the City of Oakland, including: a seller’s permit (California State Board of Equalization), business license, mobile vending permit (City of Oakland), and a health permit (Alameda County Environmental Health Department).  A copy of all permits must be provided to us with your Vendor application. If the city does not require specific permits for private property vending, please let us know.

Insurance:

All Vendors must provide proof of their own liability insurance, and name the following as additionally insured:

Sales Tax:

All Vendors selling anything must possess a resale number, collect taxes, and are solely responsible for payment of their own sales taxes.  A resale number can be obtained from the California State Board of Equalization. Applications will not be accepted without a valid resale number.

Parking:

Each Vendor will receive one vehicle parking pass for a designated area adjacent to the main mobile vending service area. Any vehicles parked in an unauthorized area of the event site will be cited and/or towed at the owner’s expense. You may not park near your booth. You must park in the designated area for vendors.  

Set Up & Break Down:  

All Vendors must be set up and ready for business by 10:00 am and you may not break down until 5 minutes after the end of the lunch service at 2:00 pm. We will not be responsible for your property if you choose to leave it overnight. No security will be provided to you the night before.

Clean Up:  

Each Vendor is responsible for the condition of his/her space during and after this event.  Each space must be kept neat and clean at all times during the event. Each vendor is responsible for bagging and disposing of all garbage and waste in designated areas. No food waste, grease or trash items will be left on or around your space.

Security & Liability:

You are responsible for your truck, trailer, cart, merchandise, and belongings at all times.  Security will not be provided as to the relative safety of your equipment or merchandise. Please do not leave valuables unattended. If you choose to leave equipment or merchandise unattended (overnight), you do so at your own risk. Insurance to cover these risks should be carried by the Vendor at no cost to the Common Grounds.

Food Handling:  

All Food Vendors must at all times follow all food handling requirements as ascribed by the Alameda County Health Department.  Any breach in the food handling policy is a violation of the terms of this agreement, which may result in the immediate termination of this agreement, forfeiture of fees paid, and immediate closure of your booth.  Please do not handle U.S. currency/money and food at the same time. There will be no water supply outdoors in your area, therefore, please bring your own washing and water supply.

Transactions:  

Vendor is responsible for all transactions/exchanges with Customers. If you have a problem with any attendee and are requesting them to leave please let us know.

 

Vendor Fees & Scheduling

MOBILE VENDOR FEE by CATEGORY:

1. Push-Cart

The Push-Cart rate is for any stationary or pushcart kitchen. This discounted category is provided for you because your pushcart requires less space due to off-site prep work. If your push-cart takes more than 6’x6’ of space, you must apply for the Full Kitchen Trailer or Truck category.

2. Full Kitchen Trailer or Truck

The Full Kitchen Trailer or Truck rate is for any full-sized trailer or truck. Trailers larger than 10’ W are restricted due to size and applications will not be accepted.

3. Special Arrangement

For unique setups (smaller trucks or booths) or irregular schedules, please schedule a call to discuss options for other arrangements made directly with management.

SITE CLEANing fee/penalty:

Basic site cleaning is included in your mobile vendor fee. However, each vendor is responsible for the condition of his/her space during and after this event.  Each space must be kept neat and clean at all times during the event. Each vendor is responsible for bagging and disposing of all garbage and waste in designated areas. No food waste, grease or trash items will be left on or around your space. A cleaning penalty of $250/day will be assessed if the conditions above are not observed.

Scheduling:

Space allotment and scheduling will be made at the discretion of Common Grounds management.

Pop-up Hours of Operation:

Beginning July 25, 2019
Ending September 29, 2019
Days of Operation: Thursday, Friday, Saturday, Sunday
Customer Open Hours: 10am to 2pm (Set up and ready for business by 10:00 am. You may not break down until 5 minutes after the end of the lunch service at 2:00 pm)

 

Vendor Release & Hold Harmless Agreement

This agreement is entered into by and between Dy & Company, Inc. dba Common Grounds (Owner) and the person filling out, signing, and returning the application (Vendor).

The “Owner” is in the business of providing space for the display and sale of food and beverage.

Vendor agrees to participate and/or allow its name and image to be shown in all media.  Vendor agrees to cooperate in any venture arranged by the “Owner” including but not limited to the following promotions; A.) Radio & Television promotion (Vendor may provide the “Owner” complimentary product at its discretion for promotional purposes).

The Vendor hereby indemnifies and holds the “Owner”, City of Oakland, its subsidiaries, agents, employees and service providers, contractors, volunteers and Clients, or its subsidiaries, agents, employees and service providers, contractors, volunteers and Clients, harmless from any and all claims, including but not limited to costs and attorney’s fees resulting there from, arising out of said Vendor’s participation in this event. For the purpose of this agreement, the term “participation” shall include, but not be limited to, the delivery of equipment, merchandise, structures and product to their designated location, the set up and display of any such structure and arts or crafts, and the dismantling and removal of all such items from the area provided by or through the “Owner” or its agents, employees and service providers, contractors, volunteers or the Client or its subsidiaries, agents, employees and service providers, contractors, volunteers and Clients.

The Vendor hereby expressly assumes any risk of harm to the Vendor arising out of their participation and the participation of other “Vendor”, including any risk resulting from the particular location of the space designated to them by the “Owner”.  Insurance to cover these risks should be carried by the participants at no cost to the “Owner”.

This agreement shall be effective immediately upon execution and shall continue in effect throughout the designated period.

Seller’s Permit

In order to sell items at Common Grounds you must have a Seller’s Permit, which you may obtain through the California State Board of Equalization.  In addition, you are solely responsible for collecting and paying all sales tax at the determined city and state rate.
